Let us note that St. John Paul II recognized that "they cannot". Benedict XVI was even more forceful in saying that in some cases "objective circumstances are present which make the cohabitation irreversible, in fact." (SC 29b).
Lionel: This is classic philosophical subjectivism.It is being said  that there are some objective situations when mortal sin could be judged as not being a mortal sin and it could be known that the person living in this irregular situation is not going to Hell.
It is being suggested that Pope Benedict and Pope John Paul II support this as if this would make it correct.Since they have also supported salvation outside the Church with a theory which violates the Principle of Non Contradicition.

THE LEGITIMACY OF A CHANGE IN DISCIPLINE
Is this change possible and acceptable? Can Francis accept what was taught by St. John Paul II and yet open a door that was closed? Yes, because an evolution in the Church's understanding of her own doctrine and its disciplinary consequences is possible. Let us look at some historical examples.
In 1832, Pope Gregory XVI, in Mirari vos, had said that it is an "absurd and erroneous doctrine, or rather delirium, that freedom of conscience is to be claimed and defended for all men" (MV 15). In the Syllabus of Pius IX (1864) religious freedom is condemned as one of the principal "errors." But in the following century, the Second Vatican Council substantially modified these very firm ideas (cf. DH 2-3). A similar evolution occurred on the issue of the possibility of salvation outside of the Catholic Church. We recall also the case of slavery: Pope Nicholas V allowed the king of Portugal to take slaves. Then, in 1455 the Bull Romanus Pontifex reaffirmed this. And this is not a secondary issue, since it has to do with the inalienable dignity of the human person. (With respect to this subject of the evolution in the understanding of the doctrine, the examples can be taken into account which are given in: Thomas Rausch, “The doctrine in the service of the pastoral mission of the Church,” La Civiltà Cattolica, v. 3981, May 14, 2016; pp. 223-236.) As of those changes in the understanding of doctrine, there were, as a consequence, various changes in discipline.
CATHOLIC STATE ALLOWS FREEDOM OF RELIGION FOR ALL

The Second Vatican Council II (DH 2-3) 1 is referring to a State with a secular Constitution.In a Catholic State, the State has an obligation to see that all are ' bound to adhere to the truth, once it is known, and to order their whole lives in accord with the demands of truth.'(DH 2)

Even during the time of the papal states non Catholics had 'religious freedom' they were immune from coercion' they could practise their religious beliefs 'within due limits'(DH-2).So there is no evolution here.

In a Catholic papal state in 2017 the Government would affirm the dogma extra ecclesiam nulla salus and Vatican Council II, with the theology and philosophy of Feeenyism and grant freedom of religion to all.It would still be a Catholic State.There would be the separation of secularism and state and non Catholics would have the freedom to follow their religion, culture and way of life.This was how it was during the times of the papal states.

WITHOUT THE OBJECTIVE ERROR THERE WOULD BE NO 'EVOLUTION OF DOCTRINE'

 A similar evolution occurred on the issue of the possibility of salvation outside of the Catholic Church.

There was an 'evolution' of doctrine here since in the Fr. Leonard Feeney case invisible cases of the baptism of desire(BOD), baptism of blood(BOB) and being saved in invincible ignorance(I.I) were mistake to be visible exceptions to the Feeneyite interpretation of the dogma extra ecclesiam nulla salus.

Once this error is corrected today by those who read the text of Vatican Council II, we are back to the old exclusivist ecclesiology of the Church and there is no 'evolution of doctrine' on this issue. Vatican Council II then no where says that there is known salvation outside the Church.

CHANGE IN SALVATION DOCTRINE WITH FALSE PREMISE RESULTED IN CHANGE IN DISCIPLINE : SAME IS BEING REPEATED WITH MORALS

So with the change in salvation doctrine because of the false premise ( invisible cases of BOD, BOB and I.I are visible exceptions to EENS) there is a new salvation theology today supported by the two popes.It is based on a false inference which is magisterial.

Similarly it is being falsely inferred that we can judge exceptions to mortal sin or consider someone in manifest mortal sin as not being in mortal sin and on the way to Hell.

Annulment factories produce annulments based on this philsophical subjectivism, of being able to judge when a marriage is not a Sacrament.They have Protestant theories like the marriage was not a marriage in the first place etc.

IT IS A FACT TODAY THAT THE TWO POPES HAVE MADE AN OBJECTIVE ERROR
It is a fact today that Pope Francis made a false judgement. He made a mistake on invisible BOD, BOB and I.I being visible exceptions to traditional EENS.Now he is saying that the Eucharist can be given to Catholics who have divorced and re-married and this is an 'evolution of doctrine' and not a mortal sin leading to the fires of Hell.
The pope who assumes invisible people who are now in Heaven are visible exceptions on earth, to all needing to be members of the Church to avoid Hell, is telling us that based on Amoris Laeitia the bishops conferences in England, Malta, Germany etc can give the Eucharist to divorced and remarried Cathollics and it would not be a sacrilege.

HYPOTHETICAL THEORIES CANNOT BE PRACTICAL EXCEPTIONS TO THE TEACHINGS ON FAITH AND MORALS
The pope who assumes there is known salvation outside the Church because since 1949 the popes have assumed unknown people were known, is now to name non Catholics as saints.These are people who are on the way to Hell according to the pre-1949 popes.They will be judged by Pope Francis as in general not being on the way to Hell.This would be an 'evolution' for Archbishop Víctor Manuel Fernández.
We know that there are no practical exceptions to the dogma EENS as it was known to the misionaries of the 16th century however it is judged by Pope Francis that LG 16, LG 8, LG 14, UR 3, NA 2, AG 11, AG 7 refer to visible people in 2017 or the past, who have been saved outside the Church.This is not common sense or Catholic teaching.
Fernandes' article contradict Pope John Paul II's Veritatis Splendor when it suggests that outward manifests of adultery are not adultery.For Pope John Paul II a mortal sin is always a mortal sin and in general the external condition indicates the internal content. If there was an exception it would only be known to God.
Veritatis Splendor rejected the Fundamental Option Theology which suggests conscience decides when a mortal sin is a mortal sin.Even the three conditions of mortal sin mentioned by Cardinal Ratzinger in the Catechism of the Catholic Church are known only to God. So in a sense they are not a measure to judge mortal sin by us human beings who can see the objective state of sin.
For example a women who is dressed vuglarly is in mortal sin.It is an objective sin and it is there before our eyes. The woman's conscience can only be known to God and it does not make it a factor in diminishing the gravity of the sin.
Fernandes wants us to believe that evil is not evil.

2. This Vatican Council declares that the human person has a right to religious freedom. This freedom means that all men are to be immune from coercion on the part of individuals or of social groups and of any human power, in such wise that no one is to be forced to act in a manner contrary to his own beliefs, whether privately or publicly, whether alone or in association with others, within due limits.

The council further declares that the right to religious freedom has its foundation in the very dignity of the human person as this dignity is known through the revealed word of God and by reason itself.(2) This right of the human person to religious freedom is to be recognized in the constitutional law whereby society is governed and thus it is to become a civil right.

It is in accordance with their dignity as persons-that is, beings endowed with reason and free will and therefore privileged to bear personal responsibility-that all men should be at once impelled by nature and also bound by a moral obligation to seek the truth, especially religious truth. They are also bound to adhere to the truth, once it is known, and to order their whole lives in accord with the demands of truth. However, men cannot discharge these obligations in a manner in keeping with their own nature unless they enjoy immunity from external coercion as well as psychological freedom. Therefore the right to religious freedom has its foundation not in the subjective disposition of the person, but in his very nature. In consequence, the right to this immunity continues to exist even in those who do not live up to their obligation of seeking the truth and adhering to it and the exercise of this right is not to be impeded, provided that just public order be observed.

Further light is shed on the subject if one considers that the highest norm of human life is the divine law-eternal, objective and universal-whereby God orders, directs and governs the entire universe and all the ways of the human community by a plan conceived in wisdom and love. Man has been made by God to participate in this law, with the result that, under the gentle disposition of divine Providence, he can come to perceive ever more fully the truth that is unchanging. Wherefore every man has the duty, and therefore the right, to seek the truth in matters religious in order that he may with prudence form for himself right and true judgments of conscience, under use of all suitable means.

Truth, however, is to be sought after in a manner proper to the dignity of the human person and his social nature. The inquiry is to be free, carried on with the aid of teaching or instruction, communication and dialogue, in the course of which men explain to one another the truth they have discovered, or think they have discovered, in order thus to assist one another in the quest for truth.

Moreover, as the truth is discovered, it is by a personal assent that men are to adhere to it.

On his part, man perceives and acknowledges the imperatives of the divine law through the mediation of conscience. In all his activity a man is bound to follow his conscience in order that he may come to God, the end and purpose of life. It follows that he is not to be forced to act in a manner contrary to his conscience. Nor, on the other hand, is he to be restrained from acting in accordance with his conscience, especially in matters religious. The reason is that the exercise of religion, of its very nature, consists before all else in those internal, voluntary and free acts whereby man sets the course of his life directly toward God. No merely human power can either command or prohibit acts of this kind. The social nature of man, however, itself requires that he should give external expression to his internal acts of religion: that he should share with others in matters religious; that he should profess his religion in community. Injury therefore is done to the human person and to the very order established by God for human life, if the free exercise of religion is denied in society, provided just public order is observed.

There is a further consideration. The religious acts whereby men, in private and in public and out of a sense of personal conviction, direct their lives to God transcend by their very nature the order of terrestrial and temporal affairs. Government therefore ought indeed to take account of the religious life of the citizenry and show it favor, since the function of government is to make provision for the common welfare. However, it would clearly transgress the limits set to its power, were it to presume to command or inhibit acts that are religious.(Emphasis added)

Cushingism is today's Arian-like heresy which has spread throughout the Church : Schneider, Fellay support it.No denial from them

Bishop Athansius Schneider does not respond to e-mails nor does he agree to a meeting and he keeps repeating the same irrational interpretation of Vatican Council II with which he is comfortable with. He mentions the Social Reign of Christ the King but will not affirm it with Vatican Council II( Feeneyite).He says that a Syllabus of Errors is needed on Vatican Council II but he himself will not affirm in public the values of the Syllabus of Errors of Pope Pius IX.He will not say that all Muslims in Kazakhstan need to formally enter the Church for salvation and all Christians outside the Catholic Church are on the way to Hell.He wants lay people to affirm the Faith and be put into prison or be persecuted  but he will not do the same.
The statements he issues are flawed theologically and doctrinally and he is unable to defend his Cushingite modernism.He feels the need to be politically correct with the Left and the Vatican so he does not talk about the difference between Vatican Council II Cushingism and Feeneyism. Perhaps it will make things difficult for him.
Vatican Council II(Feeneyite) is in harmony with the Syllabus of Errors of Pius IX and it is he who is in the Cushingite, irrational circle, the circle of error and modernism.
The Church made a mistake in the Fr. Leonard Feeney case but he will not say it in public. He is unable to announce that he is a Feeneyite on extra ecclesiam nulla salus(EENS) and Vatican Council II(EENS).Instead as a modernist in theology and doctrine he is supported by modernist Rome.
The Society of St.Pius X(SSPX) are in  a position to claim canonical status based on Vatican Council II ( Feeneyite) when bishops Schneider and Fellay proclaim the Catholic Faith.Dump the irrational version of the Council and EENS.
Doctrine is no more an impediment for the SSPX entering the Church. Doctrine was never an issue,since Vatican Council II ( Feeneyite) is in harmony  with the Syllabus of Erros of Pius IX, the dogma EENS( Feeneyite), Vatican Council II interpreted without the irrational premise and the Catechism of the Catholic Church interpreted without hypothetical cases being considered non hypothetical.Fellay and the SSPX bishops simply have to affirm the  Nicene Creed, EENS, Vatican Council II,Catechism of the Catholic Church and other magisterial documents with Feeneyism instead of Cushingism.
They meet Pope Francis' condition to accept Vatican Council II.
I repeat that they meet Pope Francis' condition to accept Vatican Council II.
Bishops Schneider and Fellay must have the courage and integrity to affirm Vatican Council II (F) and reject Vatican Council II (C).Schneider must discuss this issue, come out of his safe theological and doctrinal shell, which is protected by a magisterium  in heresy and rebellion against Tradition.
Schneider supports an Arian-like heresy through out the Church and he does not seem to know it.Cushingism is today's error like the one at the time of Arius which spread throughout the Catholic Church.
1) Since the Social Reign of Christ the King is important for him he could support political parties in Italy which affirm this teaching.They are not backed by the pro-Left popes.

Bishop Schneider could also appeal to the Polish President and Prime Minister to affirm the 'rigorist interpretation' of EENS and Vatican Council II which make it easy to proclaim the Social Reign of Christ the King.

2) Since Vatican Council II is a legitimate Council for Schneider he could specify if the Cushingite or Feeneyite interpretation is legitimate for him.
3) He could clarify that LG 16, LG 8, LG 14, UR 3, NA 2, GS 22, AG 11, AG 7 etc refer to hypothetical cases, invisible people and not known people saved outside the Church.So theologically there cannot be a new ecumenism. These references to theoretical cases are not exceptions to the dogma EENS or Vatican Council ( Ad Gentes 7 says all need faith and baptism for salvation).
4.He could also clarify that since Vatican Council II says all need faith and baptism for salvation(AG 7) Vatican Council II is exclusivist in its theology.
5.He could also in public correct the mistake on Wikipedia, the English Catholic Bishops Conference website, the website of the Vatican's Council for Christian Unity etc, when they suggest, imply and infer that Ad Gentes 11( seeds of the Word),Lumen Gentium 16( being saved in invincible ignorance) and Unitatis Redintigratio 3( imperfect communion with the Church) and others when they  refer to specifically known people in the present times or the past, who are examples of salvation outside the Church.So for them Vatican Council II is not exclusivist but inclusivist on salvation and they want the SSPX and the Franciscans of the Immaculate to repeat this irrationality and heresy.
He could respond to these points in his next interview.
